German Justice Minister Announces Mandatory Insurance for Natural Disasters

Efforts to enhance protection against flooding and other elemental damages set to be legislated by 2025.
In response to the catastrophic flooding in southern Germany in June 2024, Federal Justice Minister Stefanie Hubig has announced plans to implement mandatory insurance for residential buildings against elemental damages.

Speaking to the media, Hubig articulated the need for improved protection against natural disasters, which includes an expansive insurance coverage for elemental damages.

As per her statements, the new legislation is expected to be introduced within the current legislative term, indicating a focused effort to address the pressing issues arising from climate change-related extreme weather events.

The proposal reflects commitments made in the coalition agreement to broaden insurance coverage against elemental damages.

Hubig emphasized that the initiative aims to provide robust protection while ensuring that neither homeowners nor tenants face financial hardship as a result.

Highlighting the perils associated with floods and heavy rainfall, she noted that the consequences can be devastating for those affected.

Hubig asserted, "inaction is not an option," as the increasing frequency and severity of such weather patterns due to climate change exacerbate the risks.

Presently, many insurance policies do not cover elemental damages such as flooding and backwater events, leading to significant government expenditure in disaster responses.

Hubig pointed out that state aid often arises from political ad-hoc decisions, which should not be relied upon for long-term disaster management.

Under the proposed regulations, the mandate would first target the insurance sector.

New contracts for homeowners' insurance will be required to include elemental damage coverage.

For existing policies, there will be a designated date by which all homeowners' insurance must incorporate elemental damage protection.

To mitigate costs for private insurers and keep homeowner premiums manageable, a state reinsurance scheme is being considered.

The specifics regarding whether private property owners could opt out of the coverage under certain conditions remain under discussion.

Current estimates from the Gesamtverband der Deutschen Versicherungswirtschaft (GDV) indicate that just over 50% of private homes in Germany are insured against elemental damages.

Following the flooding tragedies in Bavaria and Baden-Württemberg, there have been increased calls for mandatory insurance to better protect property owners.

The GDV has expressed support for the government's proposal but underscores the importance of how it will be structured.

Anja Käfer-Rohrbach, the deputy CEO of GDV, noted that while mandatory insurance could assist in addressing damages, it would not prevent extreme weather events.

She additionally called for strict building prohibitions in flood-prone areas as part of a comprehensive approach to disaster risk management.

The flooding event of early June 2024 caused an estimated total damage of 4.1 billion euros in southern Germany, with around half of that damage reportedly uninsured.

Overall, severe weather incidents in the previous year caused approximately 5.5 billion euros in damages across various sectors, according to GDV data.
