Three Germans Charged with Espionage for Allegedly Selling Military Technology to China

The Federal Prosecutor accuses the trio of passing military technology data to Chinese intelligence in a case highlighting security concerns over technological espionage.
On December 20, 2024, Germany's Federal Prosecutor filed charges against three German nationals accused of espionage on behalf of China, drawing attention to a significant case of alleged technological spying.

The accused, identified as Herwig F., Ina F., and Thomas R., are suspected of gathering sensitive military technology information for the Chinese Ministry of State Security (MSS) and now face the State Protection Senate at the Higher Regional Court in Düsseldorf.

As per the prosecutor's office in Karlsruhe, Thomas R.

has been under investigation since 2017 for allegedly acting as an agent for a Chinese intelligence officer.

Along with Herwig and Ina F., reportedly a married couple, Thomas R.

is accused of collecting and relaying information on advanced technologies of military relevance.

These technologies include data on boat engines, sonar systems, aircraft defense systems, tank vehicle drives, and military-grade drones.

Central to the allegations is a business run by Herwig and Ina F.

from Düsseldorf, which purportedly served as a facade for their activities.

This company facilitated engagements with various businesses and research institutions during the espionage operation lasting from February 2017 until April 2024.

In this period, the accused allegedly amassed significant information that could potentially enhance China’s naval combat capabilities.

The prosecution alleges that Thomas R.

transmitted this intelligence to his MSS contact.

Further implicating the defendants, Herwig and Ina F.

are said to have entered a cooperation agreement with a German university for scientific exchange.

The initial phase of this collaboration involved producing a study on the technological status of plain bearings, instrumental in ship engine applications, for a Chinese client allegedly linked to MSS.

The funding for this project supposedly came from Chinese state sources.

In addition to the espionage charges, the defendants are accused of procuring three specialized lasers from Germany and exporting them to China without authorization.

This aspect of the case could entail charges for commercial violations of Germany’s foreign trade laws.

The arrests of the accused by the Federal Criminal Police Office occurred in April of the previous year in Düsseldorf and Bad Homburg, followed by extensive searches of their residences and workplaces.

While Thomas R.

remains in custody, Herwig and Ina F.

were released in October when their arrest warrants were stayed.

This case represents a significant security breach concerning Germany's strategically sensitive military technologies.

German Interior Minister Nancy Faeser remarked on the critical nature of the sector involved, underscoring the collaborative role of the Federal Office for the Protection of the Constitution in the investigation.

The implications of this case resonate beyond German borders, spotlighting global concerns about technology transfer and espionage in an era of heightened international technological competition.

The court in Düsseldorf is now tasked with deciding if and when to proceed with a trial.

The outcome may yield deeper insights into the operations of espionage networks in Europe and the broader ramifications for international security and technology exchanges.
